Liability Waiver and Release

Starter template provided by 4CornersOS as a convenience. Review it with your own attorney and edit or replace it freely — once you adopt or edit it, it is your document. This starter releases your business and the software platform provider.

This waiver applies to the athlete named at signup (the "Athlete") and is agreed to by the Athlete's parent or legal guardian when the Athlete is under 18. Read it carefully — it affects your legal rights.

1. The activities

CardiTraining LLC ("we," "us") provides athletic instruction, training, and related activities — including throwing, hitting, fielding, running, strength and conditioning, and the use of training equipment and facilities (the "Activities").

2. Assumption of risk

Athletic activity carries inherent risks that cannot be eliminated no matter how much care is taken, including strains, sprains, fractures and other injuries, being struck by a ball, bat, or equipment, collisions, overuse injuries, and heat- or weather-related conditions. You understand these risks and voluntarily choose to have the Athlete participate.

3. Health and fitness

You confirm the Athlete is in good health and physically able to take part, and you are responsible for any medical clearance their own doctor recommends.

4. Release and waiver of liability

To the fullest extent allowed by law, you release and agree not to sue CardiTraining LLC, its owners, coaches, staff, contractors, and facility partners, and Anvil GTM LLC (the developer and operator of the 4CornersOS software platform) and its owners, employees, and contractors (together, the 'Released Parties') for any claim, injury, loss, or damage arising out of the Athlete's participation in the Activities, except for injury or loss caused by a Released Party's gross negligence or willful misconduct. This release does not waive any rights that cannot be waived under applicable law.

5. Medical authorization

If you cannot be reached in an emergency, you authorize us and our staff to arrange emergency medical care for the Athlete. You are responsible for the cost of any resulting treatment or transportation.

6. Parent / guardian acknowledgment

If the Athlete is under 18, you confirm you are their parent or legal guardian and have authority to accept this waiver on their behalf.

Software platform

The 4CornersOS software used to book and manage training is provided by Anvil GTM LLC, which is not your coach and does not provide instruction or supervision. Anvil GTM LLC is an intended third-party beneficiary of the release in this waiver and may enforce it.

7. Governing law

This waiver is governed by the laws of New York, without regard to its conflict-of-laws rules. If any part is found unenforceable, the rest stays in effect.
